The Trump administration is the only one not to be in a position to denounce Iran’s violations of the JCPOA since it was the first to violate it by “withdrawing” from it, which in itself is a violation of UNSC 2231: one cannot “withdraw” from a UNSC resolution, only have it amended or rescinded -something the 14 other members of the Security Council opposed. Under the UN Charter ratified by the US Senate on 28 July 1945, UN Security Council resolutions are binding on all UN members, as the Charter says in its article 25. While Iran’s malign activities never ceased, and had to be forcefully addressed outside the JCPOA, the Trump administration’s withdrawal from the JCPOA, until then complied with by Iran, is at the origin of the present crisis, as the UK and France underscored at the Security Council.
